Hire Terms & Conditions

Axium Lumina ("the Provider") supplies equipment and services under the following Terms & Conditions.
Final wording may be adjusted per contract or hire agreement.

1. Definitions

  • Client - The person or organisation hiring equipment or services.
  • Provider - Axium Lumina / Joshua Piper operating as a sole trader.
  • Equipment - Any items supplied for hire, sale, or use.
  • Hire Agreement - Any written hire agreement, invoice, confirmation outlining items, dates, and charges.
  • Hire Period - The period from the agreed collection/delivery time until the equipment is returned or collected.

2. Quotations & Agreements

  1. All quotations are valid for 30 days unless otherwise stated.
  2. A quotation does not constitute a confirmed hire, rather equipment is reserved only once the Client signs a hire agreement.
  3. All bookings are subject to equipment availability at the time of confirmation.
  4. Signing of a hire agreement, submission of a purchase order or receipt of equipment constitutes acceptance of these Terms unless otherwise agreed in writing.

3. Equipment Hire

  1. The Provider supplies equipment as described in the Hire Agreement. Item descriptions, weights, and specifications are approximate and may be substituted with equivalent or better items if necessary.
  2. The Provider may adjust equipment lists to meet scheduling needs provided the functionality is equivalent.

4. Hire Period

  1. The Hire Period begins at the agreed collection/delivery time and ends when the equipment is returned to the Provider in full and in working order.
  2. Strict return times apply. Late returns will incur a nominal late fee and an additional full-day hire charge for each day (or part thereof) beyond the agreed return time.
  3. As such, equipment remains "on hire", and chargeable, until returned or declared a loss.

5. Charges & Payment Terms

  1. Charges will match those shown in the quotation or Hire Agreement. These may include: one‑off fees, per‑item charges, hourly labour charges, daily/weekly/monthly hire, with hire fees placed at flat‑rate, 3‑day week or 7‑day week structures.
  2. Any billing structure must be agreed in advance.
  3. Charges exclude VAT unless stated otherwise.
  4. Delivery, collection, labour, and additional services will be charged as listed in the agreement.
  5. The Client agrees to pay invoices according to the payment terms shown on the quotation or invoice.
  6. Equipment will not be released until full payment is received for non‑account Clients.

6. Insurance & Liability

  1. The Provider does not provide insurance cover for hired equipment during the Hire Period.
  2. The Client is fully responsible for all loss, theft, and damage for the entire Hire Period, regardless of cause.
  3. The Client must ensure they can cover the full replacement cost of the equipment, whether through formal insurance, risk protection agreement or self‑insurance.
  4. Replacement values will be listed on the Hire Agreement.

7. Delivery, Collection & Transport

  1. Unless agreed otherwise, the Client is responsible for collecting and returning equipment.
  2. Standard delivery/collection window: Monday–Friday, 11:00–17:00.
  3. Deliveries/collections outside these times may incur an out‑of‑hours fee.
  4. Where the Provider delivers using their own vehicle or a courier, delivery times are approximate. Delays arising from traffic, breakdowns, courier issues, or similar do not incur liability.
  5. The Client must provide: accurate delivery information, safe access to the site, and suitable unloading/loading conditions.
  6. If delivery fails due to incorrect information or access issues, the Client may be charged for a second delivery.
  7. Drivers and operators provided by the Provider are under the Provider's control unless explicitly agreed otherwise.

8. Damage, Loss & Repairs

  1. Equipment will be inspected on return.
  2. The Client is liable for all costs to restore equipment to hireable condition. This may include labour, parts, cleaning, and testing.
  3. If restoration cost exceeds replacement value, the Provider may charge the full replacement cost.
  4. The Provider may, at their discretion, reduce charges to the repair cost, but is not obligated to.

9. Cancellation

Cancellation fees apply as follows:

  • More than 4 weeks: No Charge
  • 4 - 3 weeks: 25% of hire value
  • 3 - 2 weeks 33% of the hire value
  • 2 - 1 weeks: 50% of the hire value
  • Within 2 days: 100% of the hire value

If the hire includes sub‑rented items, any third‑party cancellation fees will be passed to the Client at cost.

10. Equipment Use

  1. The Client must use equipment only for its intended purpose.
  2. The Client must not modify or alter equipment.
  3. Relevant equipment will be PAT tested on a regular schedule, and checks carried out after every hire period. The Provider ensures equipment is safe when provided; continued safe use is the Client's responsibility.

11. Site Access, Health & Safety & Conduct

  1. The Client is responsible for ensuring the site is safe, accessible, and suitable for the equipment and services provided.
  2. The Provider may refuse to install, deliver, or operate equipment if conditions are unsafe or if the Client's behaviour creates an unsafe or hostile environment.
  3. If the Provider withdraws due to safety concerns or unsafe treatment, full hire charges remain payable.
  4. The Client is responsible for any required licences for the use of Equipment, including copyright, PRS, PPL, TV Licensing, or recording permissions.

12. Ownership

All hired equipment remains the property of the Provider.

13. Force Majeure

The Provider is not liable for delays or failure to perform caused by events outside their control, including but not limited to: extreme weather, accidents, vehicle incidents, courier failure, power outages, acts of God, illness or emergency.

14. Right to Terminate or Refuse Service

The Provider reserves the right to cancel or refuse a hire if conditions are unsafe, the Client behaves abusively or creates a hostile environment, or access/working conditions are not as described. Any work completed up to the point of termination remains chargeable.

15. Governing Law

These terms are governed by the laws of England & Wales.

Changes to This Policy

We may update these Terms & Conditions from time to time. The latest version will always be published on our website, with the date of revision clearly shown.
